Regulatory framework in the area of radioactive waste management in the Republic of Tajikistan

Over the last 6−7 years a number of laws and regulatory norms have been developed, which form the regulatory base for radioactive waste management, as well as regulate handling of ionizing radiation sources. These normative acts are the following:

  • The Law of RT «On radiation Safety» (Law N 42 as of 01.08.2003 ).
  • The Law of RT «On the Use of Atomic Energy» (Law N 69 as of 09.12.2004).
  • The Law of RT «On Licensing of Certain Kinds of Activity» (Law N 37 as of 17.05.2004 with amendments N 277 as of 13.06.2007).
  • Provision «On State Regulation of Radiation Safety» approved by the RT Government Resolution N482 as of 03.12.2004 г.
  • Provision «On Specifics of Licensing of Certain Kinds of Activity» особенностях лицензирования отдельных видов деятельности», approved by the RT Government Resolution N 377 as of 01.09.2005.
  • Provision «On Interagency Council on Ensuring of Radiation Safety».
  • Provision «On Inspector of Radiation Safety Science Academy of RT».

Currently Tajikistan has other documents concerning regulation of radiation safety, which have recently approved or in the process of agreement and approval including:

  • Sanitary regulations «Norms of radiation Safety» (SR-2.6.1. −001−06).
  • "Main Sanitary Regulations Ensuring Radiation Safety".
  • Sanitary regulations «Handling radioactive Wastes».
  • "State Register and Control Procedure of Radioactive Substances and Radioactive Wastes".
  • "Requirements for ensuring radiation safety during collection and realization of metal scraps".
  • "Handling of Mineral Raw Materials with High Concentration of Natural Radionuclide".
  • Provision «On the order of expertise of documents, justifying provision of nuclear and radiation safety, sources of radiation and quality of proposed activity».
  • Procedure of arrangement and performance of inspection by the Agency on Nuclear and Radiation Security at facilities which are engaged with handling of radioactive substances and sources of ionizing radiation.
  • "Rules for radiation security during transportation of radioactive substances and radioactive wastes".

At the same time regulatory framework of the Republic of Tajikistan in the area of handling of wastes from former uranium mining industry is developed insufficiently and demands improvement and harmonization with international safety standards.    The country lacks norms and recommendations on how to provide safe handling  and rehabilitation. Due to lack of adequate mechanisms of performing such activities within the existing legislation the enterprises can not take a decision about the feasibility or provide reprocessing of uranium wastes. Therefore it is very important to continue improvement of regulatory framework for activities on mining, reprocessing and uranium waste management.
